Sabaya sentenced to 30 years in jail

FORMER Hai District Commissioner, Lengai Ole Sabaya and two others have been handed a 30-year jail term for armed robbery.

The Arusha Resident Magistrate’s Court told the jam-packed court that the trio was guilty of the charge, and their term will run concurrently.

Delivering the ruling yesterday, Senior Resident Magistrate Odira Amworo said the court was satisfied that the prosecution had proved armed robbery charges against the former District Commissioner and his co accused.

Earlier, the defendants lawyer, Moses Mauna pleaded with the court to reduce the sentence, a request which was turned down by Judge Amworo.

The ruling was postponed on October 1, because the Senior Resident Magistrate had not completed writing the verdict. Sabaya and two others, Sylvester Nyegu and Daniel Mbura completed their defence on August 24, this year after prosecution had presented 11 witnesses and eight exhibits.

The defendants were represented by Dancan Oola, Mosses Mahuna, Sylivester Kahundika, Fridolini Gwemelo and Jeston Justin.

However, speaking shortly after the judgment, Mauna said they weren’t satisfied with the verdict and were due to appeal.

The former DC and his co-accused are alleged to have committed an armed robbery on February 9, this year, at a shop belonging to Mohamed Saad in Bondeni, Arusha.

In June this year, Mr Sabaya appeared before the Arusha Resident Magistrate’s Court charged with six counts. The charges include leading a criminal gang, armed robbery, economic sabotage, money laundering and corruption.

The Court further heard that the former DC had on January 20 this year solicited 90m/- worth of bribe from an Arusha based businessman, Francis Evarist Mroso to shield him from tax evasion trial.

On separate occasion, the trio had on February 9, roughed up Sombetini Ward councillor Bakari Msangi, held him at gunpoint and extorted 390,000/- from him.
