DAR ES SALAAM: A MUSICIAN Dotto Bwakeya alias Dito has filed a civil complaint against MultiChoice Tanzania for using a song ‘Nchi Yangu’ that he claimed to be his, without his consent.
Following his complaint, Dito requested the High Court, Dar es Salaam Division to instruct MultiChoice Tanzania (DSTV) to compensate him with 6bil/-.
Dito claimed that the company used his song for commercial purposes without seeking his permission as the due owner of the song. He presented evidence before the court to prove that the respondent used his song for commercial purposes during the 2019 AFCON campaign without his consent.
The evidence that he presented included a flash disc of an advert with both audio and video.
Also, Dito asked the court to instruct the company to pay him 200m/- for damages with 25 per cent interest since he filed the case.
Before the court received the evidence, the defendant’s counsel, Mlano Mlekano, questioned the authenticity of the evidence presented.
In response to the objection made by Advocate Mlekano, Dito claimed that if the links of DSTV adverts were not deleted yet the court could ascertain itself through the Google search engine.
The Presiding Judge, Hamidu Mwanga, sustained Dito’s request and ordered the videos to be played. Former Young Africans and Simba player, Akida Makunda was seen in the video dishing out the AFCON 2019 campaign messages in line with Dito’s claimed song as a background.
